Terms of Use

1. Acceptance of the Terms

These Terms of Use (“Terms”) form a binding agreement between FindCom Online Marketplace Kenya (“we”, “us”, “Administrator”) and you.

By accessing or using the FindCom mobile application, website, or related services (the “Platform”), you agree to be bound by these Terms, our Privacy Policy, and any additional policies.

If you do not agree with these Terms, you must not use the Platform.

We may update these Terms from time to time. Changes will be communicated via email or platform notice.

2. Important Disclaimers

  • The Platform is provided “AS IS” and “AS AVAILABLE”.
  • We do not guarantee accuracy, quality, legality, or safety of user listings.
  • We do not guarantee successful transactions between users.
  • You are responsible for verifying goods/services before payment.
  • We are not responsible for user interactions or meetings.

3. Account Registration

  • You may need an account to use certain features.
  • You are responsible for maintaining account security.
  • Only one account per user is allowed unless approved.
  • We may suspend accounts for fraud, misuse, or suspicious activity.
  • You must be of legal age or use the service under supervision.

4. Service Description

The Platform allows users to post listings and communicate directly with each other. We are not a seller or buyer in any transaction.

  • Users are responsible for their listings and content.
  • We may remove content that violates laws or these Terms.
  • We may modify or discontinue services at any time.

5. User Roles

Onliners

  • Verify products before payment.
  • Meet sellers in safe public places.

Suppliers

  • Provide accurate product information.
  • Ensure compliance with laws and taxes.

Brokers / Secondary Suppliers

  • Act in good faith and maintain confidentiality.
  • Only repost authorized listings.

6. Listings

  • All listings must be accurate and lawful.
  • We may request verification documents.
  • Incorrect or inactive contact details may lead to suspension.

7. Fees

  • The Platform may include optional paid services.
  • Fees are non-refundable unless required by law.
  • We do not act as an escrow or payment processor.
  • All payments are made directly between users.
  • We are not liable for transaction failures or disputes.

8. User Responsibilities

  • You must provide accurate information.
  • You must not engage in illegal or harmful activity.
  • You must not upload malicious software or misleading content.
  • You must comply with all applicable laws.

9. Indemnity

You agree to indemnify and hold FindCom harmless from claims arising from your use of the Platform, your content, or your violation of these Terms or applicable laws.

10. Limitation of Liability

We are not liable for indirect or consequential damages. Our total liability is limited to the amount you paid us in the last 6 months or KES 10,500, whichever is lower.

11. Intellectual Property

  • You retain ownership of your content.
  • You grant us a license to use your content to operate the Platform.
  • Platform branding and materials belong to FindCom.

12. Governing Law

These Terms are governed by the laws of Kenya.

Disputes shall be resolved through arbitration under NCIA rules.

13. Account Closure

You may request account deletion by contacting support@findme.co.ke. Data will be deleted according to our Privacy Policy unless legally required otherwise.
